Sierra Club: REPLY TO OPPOSITIONS TO MOTION FOR SUPPLEMENTAL BRIEFING (ISP CISF, TX)

On August 12, 2022, Sierra Club replied to oppositions filed against its motion for supplemental briefing in the federal appeal against Interim Storage Partners, LLC’s license for consolidated interim storage of highly radioactive waste in Andrews County, Texas.

Wally Taylor of Cedar Rapids, Iowa serves as Sierra Club’s legal counsel.

Taylor, on behalf of Sierra Club, has requested the opportunity to file supplemental briefing re: West Virginia versus EPA, the Supreme Court decision in June 2020 that ruled a federal executive branch agency cannot act in ways that exceed its congressionally-granted authority, per the “major questions doctrine.”
