As posted at its website, Holtec International has appealed to the U.S. Supreme Court, regarding its highly radioactive waste dump targeted at New Mexico.
See Holtec’s Writ of Cert., here.
See the U.S. Nuclear Regulatory Commission’s closely industry-allied Writ of Cert., here.
Holtec is asking SCOTUS to overturn rulings by the 5th Circuit Court of Appeals, in 2023 and 2024, which vacated the U.S. Nuclear Regulatory Commission licenses for not only Holtec’s dump in NM, but also Interim Storage Partners’ dump in Texas.
ISP and NRC/Department of Justice likewise filed appeals with SCOTUS, two weeks ago.
Beyond Nuclear and our allies have resisted — including in the U.S. Court of Appeals for the District of Columbia Circuit — both Holtec’s and ISP’s consolidated interim storage facilities for highly radioactive waste targeted at the Permian Basin in TX and NM since before the companies applied for their licenses in 2016-2017.
