Beyond Nuclear’s co-counsel, Diane Curran and Mindy Goldstein, filed a Petition for Certiorari with the Supreme Court of the United States (SCOTUS) on October 31. Our Petition challenges the U.S. Court of Appeals for the D.C. Circuit’s repeated adverse rulings against us in the case Beyond Nuclear versus Nuclear Regulatory Commission, regarding the agency’s unlawful approval of a license for Holtec’s consolidated interim storage facility (CISF) for highly radioactive waste targeting New Mexico. On December 4, Holtec filed an Opposition Brief, while three states filed a supportive Amicus Brief. On December 12, we filed our Reply Brief, pointing out that Holtec’s arguments, or lack thereof, actually prove our case, in multiple ways. SCOTUS will likely rule by spring.
