Appealing adverse CISF ruling at D.C. Circuit Court

On October 11, 2024, Beyond Nuclear’s legal counsel — Diane Curran of Washington, D.C., and Mindy Goldstein of Atlanta, GA — met our 45-day deadline to appeal a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit.

That ruling on August 27, 2024 rejected Beyond Nuclear’s challenges to the license approved by the U.S. Nuclear Regulatory Commission, allowing construction and operation of Holtec International’s proposed consolidated interim storage facility (CISF) for highly radioactive waste targeted at southeastern New Mexico.

But on October 4, 2024, the Supreme Court of the U.S. (SCOTUS) agreed to hear a related appeal, so we have asked the D.C. Circuit Court to hold our petition in abeyance until after SCOTUS has ruled, likely by June 2025.
